You can place Mail Order Orders with Camouflage online, by phone or post. Access to our Mail Order Service will require user registration. The information that you provide must be accurate and complete. By using our Mail Order Service you are indicating your acceptance to be bound by our Terms and Conditions of Trading. They form a legal agreement between you and us and can only be amended with our consent. We reserve the right to change these Terms and Conditions from time to time without prior notice, provided that any such change will not affect any purchases you have made before the change is implemented. Your continued use of our services shall signify your acceptance to be bound by the latest Terms and Conditions.
All orders placed by you are subject to acceptance by us. We reserve the right not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. We may also close your account for any reason and will not be liable to you or to anyone else in those circumstances. Acceptance of your order and the formation of a contract between us will take place when we despatch the products ordered to you, unless we have notified you that we do not accept your order or you have cancelled it. By making an offer to purchase, you agree to be bound by our Terms and Conditions of Trading. If you do not accept our Terms you should not place an order. Goods must be paid for in full before your order will be dispatched. Please note that from the 1st September 2005 every credit or debit card transaction must be submitted to a full security check. The security check involves matching the data supplied with your order to the data held on file with your bank (as stated on your bank statement) if the data does not match the transaction will be declined.
We have taken reasonable steps to display as accurately as possible the colours and other detailing of our products. However, the actual colours and detailing you see onscreen will depend on the equipment you use to view the products. Any information regarding sizing of products is included as a guide only. If you are in any doubt as to the size of any product you require, we recommend that you contact us prior to placing an order.
If you wish to order a product where a minimum age requirement is indicated, you must confirm that you are of the required age before you will be able to proceed with the order. We reserve the right not to supply any age-restricted product where we reasonably believe that you are below the relevant minimum age. For certain age-restricted products only certain specified payment methods may be allowed.
We use both Couriers and Royal Mail for all our delivery services. If you are placing your first order you must supply your registered card holder address (Billing Address) for the delivery, the only exception to this rule is if you can supply a Police or Military address for delivery. Once an order has successfully been delivered to the card holder address subsequent orders can be delivered to an alternative address.
Please note that It is the responsibility of the Customer to ensure that someone is available at the delivery address to sign for the parcel, if no one is at the address when the delivery arrives a card will be left with details of how to arrange a new delivery or collection. If you have successfully ordered from Camouflage before and are not available at your address to sign for your delivery you may nominate a safe place for your parcel to be left at the time of placing your order. When ordering online please enter this information in the Special Requirements Section in the shopping cart. Please also note that this is entirely at your own risk as we can not accept any liability for lost or stolen items, our couriers will not leave a parcel with a neighbour or in a safe place unless instructed to do so in writing by Camouflage.
Next Day Services
• Next Day services are available via Royal Mail Special Delivery. Due to scheduled pickups, any order placed after 16:00 on Fridays will be despatched the following Monday.
• If you are not at the delivery address when the courier attempts your delivery a calling card will be left providing you with contact details and instructions, please respond to this card upon receipt.
• A signature must be obtained at the delivery address. Deliveries will not be left safe without a signature or with a neighbour unless previously agreed in writing by Camouflage prior to dispatch.
• Camouflage will not be responsible for extra delivery charges resulting from non-deliveries, if the courier is unable to complete your delivery and goods are returned to Camouflage the fee for deliveries Returned to Camouflage is £10.50 (this amount will be deducted from the value of goods returned or charged to your account before goods are re-dispatched).
• It is the customer’s responsibility to inform Camouflage of non delivery within 24 hours of receiving your order shipping/order confirmation. Our Customer Services Team will be happy to liaise with the couriers on your behalf in order to ensure the successful delivery of your order.
This service provided by Royal Mail is not guaranteed. Royal Mail aim to deliver within 5 working days, if you do not receive your order within 5 working days please contact our Customer Service Department for further information. Please note that we are unable to re-issue goods sent by our Economy Service until 15 working days have passed from the dispatch date.
Returns and Order Cancellation
You also have a statutory right to cancel your purchase. If you wish to cancel you must tell us in writing, by telephone, or email email@example.com upon receipt in order to obtain a Returns Number. You should keep evidence of having given your cancellation notice, such as a certificate of posting. You must take reasonable care of the product and you must return the product to us (at your own risk and cost) within 14 days of dispatch. All goods remain your property until they are received by our Returns Department. The product must be returned unused (except to the extent use was reasonably necessary to examine the product) and with the original packaging and Sales Receipt with the reverse section completed with the Returns Information. We will refund the purchase price of the product less the delivery charges. The following products are excluded from this legal right to cancel: audio/video recordings, DVDs or computer software that you have taken out of the sealed packaging in which they were delivered to you; products made to your own specification, Books and any other products that by reason of their nature cannot be returned such as earpieces for hygiene reasons.
Faulty or Damaged Products
We will refund the purchase price together with the delivery charge for any product which is delivered in a damaged or faulty condition. We will warranty any product which develops a fault within a period of 6 months from delivery (other than due to normal wear and tear, failure to follow instructions or misuse) Camouflage will replace the product with the same, or a similar product (subject to stock availability). Once six months from date of purchase have passed you will be referred to the Manufacturers warranty, therefore it is imperative that you keep the documentation supplied with your product. If you have a faulty product please Contact our Customer Service representatives for further information. As some products may need to be referred to the manufacturer you must allow 30 days from our receipt of your product for your refund to be processed or a replacement product to be despatched. We reserve the right to refuse to issue a refund/replacement product and to recover the cost of the return delivery from you in the event that the product is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear. Products received faulty must be reported upon receipt and all packaging materials retained. Nothing in this section or elsewhere in these Terms and Conditions or in our returns policy affects your statutory legal rights.
All prices in our website include VAT at the current rate of 20% where applicable.
Security and Data Protection.
We are committed to protecting your privacy and the security of any information given to us in order for us to process your order. We will not sell or pass your details to third party organizations except for the purpose or processing your order.
We will not be liable to you where performance of any of our obligations is prevented or restricted by any circumstance or cause beyond our reasonable control. You are responsible for the use you make of the products you order. To the extent not prohibited by law, we accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses). We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentation and any other liability that cannot, under English law, be excluded. Any formal legal notices should be sent to us at the address at the end of these Terms and Conditions by post or by email and confirmed by post. Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms and Conditions.
If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and shall remain in force. No term of any contract subject to these Terms and Conditions shall be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to such contract. You and we agree that English law applies to these Terms and Conditions and that any dispute between us arising out of or in connection with these Terms and Conditions will only be dealt with by the English courts, unless you are resident in another part of the United Kingdom, in which case the applicable law of that part of the United Kingdom will apply and any dispute will be brought before the courts there.
